Terms of Use

1) Timelines offer

    a) Timelines is an offer by mediawaves services GmbH, Brüsseler Platz 8, 50672 Köln, Germany ('the operator'). Timelines offers users a platform to create various events (“Events”) online using a virtual timeline and to store entries in the form of values ('Values').

    b) The registration of a user account is required to use the platform. With an account, the user ('User') can then access the Timelines platform via app.

    c) Apps are currently available for Android and iOS systems. Details and technical requirements can be found in the respective technical descriptions in the AppStores.

    d) The use of Timelines is currently free of charge. The operator reserves the right to offer paid functions in the future. In this case, a separate contract for the paid functions will be concluded with the users if necessary. Furthermore, the operator also reserves the right to market Timelines in future, in particular to place advertising within the apps.

    e) Timelines stores Events and Values exclusively in a cloud solution. Local storage is not possible. Cloud services from Amazon (AWS) are used. Details can be found in the privacy policy.

2) Timeline functions

    a) Basic functions

    Users have the possibility to use Timelines with the provided functions after registration. These are the basic functions: 'Create and change Events' and the possibility to add 'Values'. The Events can be viewed and managed using a virtual timeline.

    b) Other functions

    Further functions will be added in the future in operator’s discretion. However, there is no entitlement to this. The operator may discontinue or restrict these at any time and without giving reasons. Additional functions may also be offered for a fee.

    c) Restrictions on use

The use of Timelines and all components is only permitted for the user's own purposes (e.g. for the administration of own events). Reselling and in particular passing on the services to third parties (free of charge or with costs) is not permitted unless otherwise agreed. If a user violates this restriction, the operator is entitled to extraordinary termination with immediate effect.

3) Availability / liability / termination / extraordinary termination

    a) Availability

    The operator endeavours to ensure the best possible availability of Timelines, but does not guarantee continuous error-free operation. This can be limited, in particular by maintenance work. Timelines endeavours to give timely notice in advance.

    b) Liability/ responsibility for information

    (i) The operator is liable for damages in the case of culpable injury to life, body or health as well as in cases of intentional or grossly negligent actions according to the legal regulations. The liability for damages caused by slight negligence is limited to essential contractual obligations, i.e. such obligations whose fulfilment is essential for the proper execution of the contract, whose non-fulfilment would endanger the purpose of the contract and on whose fulfilment the User regularly relies.

    (ii) The user acknowledges that no software is error-free and that no guarantee can be given that it is compatible with all terminal devices or that all components will function in all hardware and software constellations. The operator endeavours to keep Timelines up to date and state of the art at all times. Faults/bugs will be corrected as soon as possible after they become known.

    c) Termination

    (i) The user has the possibility to completely cancel and terminate the use of Timelines at any time. The termination of the use of Timelines as a whole is possible on Timelines itself (by deletion in the user profile), in writing or by e-mail.

    (ii) The operator is entitled to terminate the contract for the use of Timelines at any time with a notice period of two weeks to the end of the month. This can be done by email to the email address provided during registration.

    d) Extraordinary termination

    The operator is entitled to immediate termination for good cause. Such an important reason exists in particular - but not exclusively - if

    • the user disassembles or resells the software or otherwise violates copyrights with regard to Timelines.
    • the user offers the software/Timelines as a service for others (reselling) (unless permitted by the operator)
    • the user attempts to gain unauthorized access to the systems of Timelines (hacking)
    • the user uses Timelines for illegal or immoral purposes.

4) Changes to these terms of use

The operator is entitled to change these terms of use. Users will be informed of any changes in a suitable manner. The user can object to changes within 14 days. If he does so, the terms of use valid at the time of the conclusion of the contract remain valid until the contractual relationship ends. However, any new functions covered by the changes may not then be available. If the user does not object to changes within a period of 14 days after notification, the changed terms and conditions of use shall then become solely decisive for the contractual relationship.

5) Applicable Law and Place of Venue

The law of the Federal Republic of Germany shall apply - insofar as this is legally permissible and no other law is necessarily applicable. The the UN Convention on the International Sale of Goods (CISG) is excluded.

If the user is an entrepreneur (according to § 14 BGB), legal entity under public law or special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Cologne. The same applies if the user does not have a general place of jurisdiction in Germany or domicile or the usual place of residence is not known at the time of filing the suit. The text of all provisions is subject to German law and shall be interpreted in accordance with German law.

6) German and English language version

The English language version of these terms and conditions is for information purposes only. Solely the German version applies. In cases of contradictions the German version supersedes the English version.
